TWO men are facing charges before the Regional Trial Court (RTC) Davao
City Branch 10 for burning down the house of one of the respondent's brother at Barangay Acacia in Buhangin, Davao City last March 19.
Facing arson charges are Orlando Umpad Jr. and Leonardo Relevante.
Prosecutor Oliver Saniel found probable cause to charge the two based on the complaint filed by Reynaldo Umpad, brother of Orlando and his cousin Ricky Pinario.
Reynaldo, in his affidavit, said was staying at his other home in the same barangay when he was informed by his cousin that his house is being burned by Orlando and Relevante.
Reynaldo rushed to the burning house bringing along with him a pail of water to extinguish the fire. But his efforts was futile, his house was razed to the ground.
Pinario, in a separate affidavit, said he along with his family was temporarily residing at the house of Reynaldo. Pinario said he and his family were already sleeping when the arson happened.
The wife of the complainant was awakened upon sensing that gas was being poured inside the kitchen. A fire then broke out prompting Pinario and his family to flee the house.
Upon exiting the house, the complainant allegedly saw Umpad and Relevante fleeing from the scene. Pinario also said he, his wife and his four children sustained minor burns.
The following day, two respondents were arrested at their respective residents with the help of the barangay officials and Buhangin police.
Prior to the incident, Reynaldo stated in his affidavit that he and Orlando had an argument on the ownership of their family house in Brgy. Ilang, Tibungco. He also said that his brother threatened to kill him and burn his house.
The two are currently detained at the Buhangin police station while RTC Branch 10 presiding judge Retrina Fuentes is yet to schedule the arraignment of the respondents.
