Cases vs 9 Matanao raid suspects not dismissed

A TOP official of the Davao del Sur Provincial Police Office (DSPPO) maintained that the cases filed against the nine suspected communist rebels arrested after the raid in the Matanao Municipal Police Station in Davao del Sur last March 11 were not dismissed.

DSPPO director Senior Superintendent Michael John Dubria, in an interview, said the investigation on the nine rebels identified as Johnrey Moher, Jolito Sales, Rofo B Nabundasan, Roger Natunton, Christopher Sales, Joey Alberca, Noel Alba, Lodemer Gama Bagumbayan, and Reynante Orot Paradise is still ongoing. The nine were charged with three counts of multiple murder, three counts of frustrated murder, malicious mischief and robbery.

"When we filed the case, ni-require ang mga akusado to file their counter-affidavits to answer the charges. Wala pa pong finality ang kaso. Hindi po ganun kadali mag-dismiss ng cases," Dubria said.

The inquiry stemmed from the statement of Eastern Mindanao Command (Eastmincom) Public Affairs Office chief Lt. Col. Patrick Cinco who said he received information that the case was dismissed.

When asked if he was aware of the dismissal of the case, Cinco said: "Actually may tumimbre sa akin. Pero nanghinayang tayo dahil yung siyam ay talagang miyembro ng New People's Army (NPA). Nagkataon lang na we lacked evidence. Siguro negative sila sa paraffin test pero ang mga tao dun sa Matanao nakapagsabi na miyembro talaga sila ng NPA."

He added that there is still an ongoing investigation in the case.
