THE Office of the Ombudsman-Mindanao recommended the filing of charges against a former barangay treasurer accused of failing to give the honoraria of three other officials of Barangay Communal between 2008 and 2009.
Facing seven counts for violation of Article 217 (malversation of public funds) of the Revised Penal Code is Susana Galvez, former treasurer of Barangay Communal.
Graft Investigation and Prosecution Officer (GIPO) II Quinitin Pedrido Jr., in a joint resolution dated August 3, found probable cause to charge Galvez based on the complaints of former barangay kagawads Maximo Singson and Alma Agbayani and former Sangguniang Kabataan (SK) chairperson Diezy May Daniel.
The complainants said they were supposed to be paid P5,000 for the annual cash gift and the monthly honorarium of P6,848.
But Singson and Agbayani claimed that they did not receive their 2008 cash gifts and their December 2009 honorarium while Daniel said he did not get his 2008 cash gift as well as the honorarium for the months of November and December of 2009.
Galvez stated in her counter-affidavit that former village chief Arnold Maalat volunteered to handle the disbursement of honoraria for the month of July 2009. The July 2009 budget for the honoraria, however, was not disbursed. Galvez claimed that Maalat allegedly used the honoraria budget from August to October of the same year to cover the losses in July until there were no more funds to cover the months of November and December.
Galvez also blamed Maalat for mishandling the 2008 cash gift budget.
Maalat, in his counter-affidavit, denied the allegations insisting that he only approved the release of the annual cash gift budget and the honoraria for the kagawads for the months of November and December of 2009 but he did not receive the money.
Pedrido, however, was not convinced with the defense of Galvez since it was discovered that her signature was affixed at the "paid by" portion of the payroll for the 2008 cash gifts and the November and December 2009 honoraria.
The complainants also accused Maalat for conspiring in the malversation but Pedrido dismissed the charges against him as there was no evidence to support the allegations.
The case was raffled off to the Regional Trial Court (RTC) Branch 10 but Presiding Judge Retrina Fuentes is yet to schedule the arraignment of the respondent. (RSA)
