DEFENSE lawyer Carlos Zarate said he is now waiting for the prosecution's written motion on illegal gun possession charges against a broadcaster in relation to Fernando Lintuan's slay in 2008.
"Iba na ang prosecutor na mag-handle ng case and fiscal Garcia (Jose) manifested that he will just adopt the witnesses and evidences and mag rest na sila. So, I'm planning to file a demurrer," Zarate told Sun.Star Davao.

This after the prosecution submitted a motion for reconsideration so that the clutch bag seized from the accused, Leonilo Larosa, will remain as evidence.
MTCC Judge Antonio Laolao earlier granted the motion to suppress evidence submitted by Larosa, claiming the clutch bag that contained guns and ammunition was seized illegally.
The accused was arrested by National Bureau of Investigation (NBI) operatives on the strength of a warrant issued by the Regional Trial Court (RTC) Executive Judge Isaac Robillo.
The search operation yielded a Colt Mark IV series 80, a caliber .38 Super Pistol, four magazines, 32 rounds of caliber .38 ammunition, one magazine pouch, one outside gun holster, and one black clutch bag.
Larosa was earlier acquitted of the murder charge filed against him for the death of Lintuan in the morning of December 24, 2008.
