IRONY of ironies! In this whole crazy world, it is only in the Philippines where the real crooks and criminals rule over and cook up laws that serve their selfish interests and dictate on their masters who are keeping them up in the helm of power. And we are the only country who would convict the innocent people, exact hefty sums on them or send them to jail on the pretext of serving the rule of law when in truth and in fact, what they were after was to serve the whims and caprices of the moneyed few.
Such contrasting times that we have? While the criminal cases of the real murderers of the Ampatuan massacre dragged so excruciating slow in court even when the justices already got ample evidence to pin down the culprits and send them to 'eternal fire' for the gravity of their misdeeds, here's a 'little libel' case that has not even been fully proven that that there is any 'malicious intent' in publishing a drug-related story that merely lists names involved.
Is it not the 'malice' on the side of the accusers who did not stop at the omission of the culpability of the "official source" which was the police report, and the exclusion of the writer of the report among the accused, but was even unable to establish at how the libel was defined in dictionaries, as some kind of "defamation: a false and malicious published statement that damages somebody's reputation." Watch out media people, the rules of journalism has been reversed by the judiciary of this land.
Which is more grave a crime then? Has our judiciary totally restate the meaning of criminal offense "beyond reasonable doubt" to a lesser 'crime' in libel, while grievous, heinous killings of members of the press, among others, as nothing but a piece of cake, such that the prosecution of the murderers take so ages to decide on and the wheels of justice grind so slow?
Big joke it is!
Like poising a stick to children of old supposedly to discipline naughty children, the judiciary seemingly has this simplistic solution of trying to silence the press by picking an example on flimsy pretext and make a parody of justice. With threats poised of curtailing its freedom (legally) of expression so this would send the message to every vigilant scribe worth her/his piece in the land, the judiciary is acting like an intolerant parent ready to strike at a hapless child with normal mischievous tendencies?
It is as if the Fourth Estate is being considered by the courts as a nuisance that has to be dealt with. When will they ever learn?
But then the 'honourables' in this land of jokes can never swallow simple truth, and this has been so since time immemorial. There has been so many "celebrated" cases that merely melted in thin air after a while, forgotten by the public that such ever existed or happened at all. Sad to note, but is there any hope at all that our socio-political and economic system would really, truly serve the interests of the people it seeks to serve?
If the great hold-uppers and thieves now sitting in the senate and congress don't give a damn on the state of damnation that the Filipinos are in as they continue to bleed the nation dry, what hope do we have to look forward to? If the President care at all, as he is seemingly playing games with the unscrupulous in the pork barrel scam, would he make every effort to drag to justice the real culprits and not further place the Filipinos is uncertainty and disillusionment?
