Dole issues pay rules for holidays

CITY OF SAN FERNANDO -- The Department of Labor and Employment (Dole) on Thursday issued the Labor Advisory No. 03, Series of 2012, promulgating the pay rules applicable for October 26 and November holidays.
“Pursuant to Proclamation Nos. 295 and 488 issued by President Benigno Aquino III on November 24, 2011 and October 9, 2012, respectively, the following rules for pay on regular holidays on October 26 and November 30 and special days on November 1 and 2, 2012 shall apply,” Rosalinda Dimapilis-Baldoz, Dole secretary, said in issuing the labor advisory.
The labor advisory was issued through its Central Luzon office headed by Director Raymundo Agravante.
President Benigno Aquino III has declared October 26, Friday, a regular holiday throughout the country in observance of Eidul Adha or Feast of Sacrifice.
November 1 and November 2 are special non-working days while November 30 is a regular holiday.
The rules, based on the advisory, stated that for regular holidays, if an employee did not work, he shall be paid 100 percent of his salary; if the employee worked, he shall be paid 200 percent of his regular salary; if an employee worked more than eight hours, he shall be paid an additional 30 percent of his hourly rate on said day; if an employee worked during a regular holiday that falls on his rest day, he shall be paid an additional 30 percent of his daily rate of 200 percent; and if the employee worked for more than eight hours that falls on his rest day, he shall be paid an additional 30 percent of his hourly rate.
For special non-working days, the advisory notes that if an employee did not work, the “no work, no pay” principle shall apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day; if an employee worked, he shall be paid an additional 30 percent of his daily rate on the first eight hours of work; if an employee worked in excess of eight hours he shall be paid an additional 30 percent of his hourly rate; if an employee worked during a special day that falls on his rest day, he shall be paid an additional 50 percent of his daily rate on the first eight hours of work; and if an employee worked in excess of eight hours during a special day that falls on his rest day, he shall be paid an additional 30 percent of his hourly rate.
