CITY OF SAN FERNANDO -- Third District Representative Oscar Rodriguez clarified Friday that the claim of former representative Aurelio Gonzales, Jr. that he "does not deserve to occupy his position because he has betrayed public trust" is merely an allegation cited in the dispositive portion of House of Representatives Electoral Tribunal (HRET)'s resolution.

The HRET dismissed Gonzales' election protest for lack of merit.

"What he (Gonzales), cited as Paragraph 36 is part of the allegations that were never substantiated in his protest. It seems that he is confused and is confusing the public," Rodriguez said.

He added: "A lot of people have been calling me on this and sabi nga nila, siya na ang talo sa kaso siya pa ang vindicated. I hope that this will be clarified."

Paragraph 36 of the HRET Case No. 13-011 resolution, which Gonzales noted stated that “All told, Protestee (Rodriguez) failed to prove that the disbursements were made under the exceptions set forth under the law.

Therefore, the issuance of checks and release of financial assistance fall within the ambit of vote buying as described in Section 262 of the Omnibus Election Code. Accordingly, Protestee should be held liable for his wrongdoings.”

Earlier, Rodriguez said that he was happy about the HRET decision.

“Wala naman kasi talagang basihan yung protesta ni Dong Gonzales laban sa akin. Hindi naman ako namili ng boto tulad ng paratang niya. Masaya ako sa naging resulta nung desisyon, although expected ko na talaga na madi-dismiss,” he said. (JTD)
