THERE was a time when household helpers were a lowly lot, mistreated, taken for granted, outrightly ignored or worse, abused. But no longer, because with the passage into law (RA No. 10361), or an Act Instituting Policies for the Protection and Welfare of Domestic Workers, their plight has been recognized and their woes addressed and seriously looked into.
The law was signed on January 18, 2013 and the Implementing Rules and Regulations (IRR) were promulgated on May 9, 2013.
In its Advisory dated July 11, 2013, DILG Region 3 headed by Florida M. Dijan, DPA, CESO III, asked all provincial/city directors, municipal/city LGOOs, city/municipal mayors, punong barangays and others to help disseminate the guidelines for the barangay registration of all kasambahays nationwide.
And rightfully so, as the local domestic helpers (as distinguished from outbound DHs), have been neglected for so long and the legal (lawful) privileges and benefits overlooked.
In Memorandum Circular 2013-61 dated July 8, 2013, it is stated that "all city or municipal mayors are enjoined to initiate the conduct of the registration of all Kasambahays within their jurisdiction and to require every employer to register his or her domestic workers under his or her employment in the Kasambahay Masterlist or the Registry of the Domestic Workers in the barangay where the employer's residence is located".
Additionally, the Punong Barangay is enjoined to devise a system to ensure the registration of all Kasambahay in his or her barangay including an on line registration through the barangay official website or e mail.
The start-up registration was scheduled since July 2013 yet, with the city or municipal mayor expected to coordinate the orderly management of the schedule of the registration which is continuous. Representatives from the Pag-ibig, Philhealth and SSS are expected to be invited to expound on the law and its IRR and accept applications for membership of the kasambahay.
Under the guidelines, punong barangays shall designate Kasambahay Desk Officers to manage Kasambahay desks. This is a tough job, but it is so mandated by law.
Further, the city or municipal mayor and the punong barangay are to conduct continuous information dissemination pertaining to the registration of kasambahays and, of course, the implementation of the Kasambahay Law, with minimum circumventions as is the habit of the Pinoy.
There are several registration forms designed to be accomplished by the foregoing officials and are to be submitted to the proper agencies. As the new law now requires, the Kontrata sa Paglilingkod sa Tahanan and payslips are to be done and later submitted to the corresponding government agencies. See, the current kasambahays have to law to run to for their protection and the benefits befitting them are to be given to shore up their dignity and person.
The days of poor accommodation to kasambahays are now over as they enjoy the full protection of RA 10361 or the Kasambahay Law.
