City claims in lieu shares By Christine Mae Pelayo
THE city government is claiming its ‘in lieu’ shares from the Bacolod City Water District.
Lawyer Vicente Sabornay, city legal officer, said the city government is now waiting for the draft of Baciwa’s proposal for a compromise agreement.
“We had a conference with the Baciwa management and lawyers last week. We came up with terms and principles to settle the claims and counter-claims,” said Sabornay.
He added that if the city finds the compromise agreement in order and not detrimental to the interest of the public, it will accept Baciwa’s proposal.
The ‘in lieu’ share is the city’s share for the transfer of the value of the Yulo Water District which was assumed by the Baciwa management several years ago.
The city government owned the Yulo Water District before Baciwa claimed its management under Presidential Decree No. 198 stating that cities are required to spin off all water districts from its jurisdiction.
Lawyer Jovim Entila, one of Baciwa’s counsels, told Sun.Star Bacolod the city government wanted to get its annual shares on the value of the Yulo Water District from Baciwa, which the city has not claimed for several years.
“It is in lieu of the payment of the property assumed by Baciwa where there were certain percentage involved in the sharing,” Entila said.
He added that part of their compromise agreement with the city’s ‘in lieu’ share is to offset its accounts with Baciwa.
“It will include the shares in the natural resources because daku ang sulukton sang Baciwa sa city pero i-apply as payment to the special fund for the development of water resources,” Entila said./CMP
