“The Sangguniang Panlungsod is doing the `boss,’” said Lawyer Vicente Sabornay, city legal officer, on the discovery of the tactical plan reportedly hatched by the City Mayor’s Office, which aimed to pressure the council to pass the 2003 budget.

“They are employing the tactic of preemption because they knew they have delayed the passage of the approval of the budget,” he said.

Sabornay added: “In order to absolve themselves from criticisms and other adverse opinions, they preempt the coming out of the tactical plan.”

But opposition Councilor Archie Baribar said the SP is given until March 30 to approve the budget as stated under the Local Government Code or RA 7160.

“We are not preempting. The tactical plan did not come from us. It came from the City Mayor’s Office,” Baribar told Sun.Star Bacolod.

Vice Mayor Ramiro Garcia, likewise, brushed off Sabornay’s statement.

“Let him say what he wanted to say. Let the people decide as to who has the credibility,” he said.

Legal or not?

Barangay kagawads scored Baribar’s pronouncement over a radio interview inquiring into the existence and legality of the Liga ng mga Barangay Kagawad.

This came after the name of the Liga was included to those reportedly behind the tactical plan.

Francisco Doctora, Liga ng mga Barangay Kagawad president, said Baribar’s comments were entirely ‘irresponsible’ and malicious.

They were made to gain political mileage without consulting the basic fundamental law of governance, Doctora added.

Moreover, Doctora said the Liga’s existence and formation is not arbitrary and contrary to law but based on existing provisions of RA 7160.

Baribar, however, believes otherwise.

He said there is no provision in the Local Government Code that barangay kagawads could form an association.

“There is no malice. I take responsibility on my word. If there is malice, the barangay kagawads should have investigated why they were included in the tactical plan and what is the role of Banaagg,” Baribar said.

But the Liga, in a press release cited section 508 of RA 7160 as the reason for their existence.

The section states: Organization - vice governors, vice mayors, Sanggunian members of barangays, municipalities, component cities, highly-urbanized cities and provinces, and other elective officials of local government units, including those of the Metropolitan Manila area and any metropolitan political subdivisions, may form their respective leagues or federations, subject to applicable provisions of the title and pertinent provisions of the Code./CMP
