Gamboa disappointed with local election office By Avelyn Z. Agudon
THE Commission on Elections (Comelec) dismissed for lack of merit a motion for consideration on the pre-proclamation protest filed against reelectionist E.B. Magalona Mayor Alfonso Gamboa.
In a three-page decision, the Comelec en banc dismissed the motion for consideration filed byGamboa’s opponent, Reynaldo Depasucat.
The Comelec, headed by Chairman Benjamin Abalos Sr., ordered the Municipal Board of Canvassers of E.B. Magalona to complete the canvass for the results of the mayoralty race in the May 14, 2001 elections and proclaim the winning candidate for mayor.
But Comelec provincial supervisor Marsha Cordero said the Municipal Board of Canvassers cannot convene because they have yet to receive the order.
Gamboa expressed frustration over the local Comelec for its alleged failure to follow up the pre-proclamation protest.
“They are not doing their job. I’m really disgusted,” she said.
He also suspects that the local Comelec's failure to conduct a follow-up on his case is part of the delaying tactics.
Gamboa earlier considered the Comelec’s delay as “mass disenfranchisement” of voters because the people’s right to choose their leader was not heard.
The pre-proclamation protest was dismissed on Nov. 22, 2003 by Commissioner Ralph Lantion but Depasucat filed a motion for reconsideration.
Depasucat filed the election protest claiming that he is a victim of “dagdag-bawas” in 2001’s election.
He also protested the inclusion of certain election returns, which he “discovered to have certain material and anomalous defects.”
He said the election returns were tampered when Gamboa’s men were reportedly allowed to sleep inside the canvassing room, while his (Gamboa’s) watchers were barred from going inside.
He also questioned the results presented by the Board of Canvassers showing Gamboa’s lead of 194 votes when the result of Namfrel’s tally showed that he is leading by 1,041 votes.
