Hearing on admin raps v. Valdez set November By Christine Mae A. Pelayo
THE Department of Interior and Local Government will hear the case for usurpation of authority, ignorance of the law with prayer for immediate suspension against Mayor Luzviminda Valdez on Nov. 10 and 11, at the DILG office in Bacolod.
Two DILG investigators will hear the case.
Earlier, the Teresa Development Corp., represented by Geraldine Marie Ramos, filed the complaint against Valdez before the Office of the President.
The complaint came after the City Government demolished the obstruction on the main drainage in Barangay Bata.
Valdez, however, said she is unfazed over the scheduled hearing adding that she has prepared her counter statements.
“We have prepared our defenses and our witnesses,” she said.
Valdez, in her counter-affidavit, earlier denied all allegations against her.
She said that “the complainant clearly and maliciously stated the real motive of their complaint when he said "respondent is the elected Mayor of the City of Bacolod, (and) won by a very slim, insignificant number of votes during the 2001 local elections."
Morever, the City Legal Office also forwarded its answer and opposition to the ex-parte motion for suspension on the complaint against Valdez before the Office of the President.
Lawyer Vicente Sabornay, city legal officer, prayed that the complaint be denied for utter lack of merit aside from being malicious and politically-motivated.
He said Valdez’s act did not constitute an offense involving turpitude and that she did not usurp authority and is not ignorant of the law.
He said Valdez can declare the obstruction in the drainage a public nuisance without the approval of the council.
Sabornay explained that the floodings in Barangay Bata are public nuisance and despite the city’s plea to the owner of the property to discuss the problem, the owner never heeded its (city) request.
He reiterated that before the City Government undertook the demolition of the obstruction in the drainage, the city has carefully studied its moves.
