Firm insists: Council was informed

CONTRARY to the City Council's claim, the Consuelo Development Corporation informed the Council about the flooding problem in Barangay Bata, lawyer Romeo Subaldo, counsel for Consuelo Development Corporation, said.

Subaldo, in a letter addressed to the Council, took exception to the Council's allegation that the matter was not presented to it as a collective body.

"The problem was brought to the attention of the Sanggunian (Council) as evidenced by facts," said Subaldo.

He cited several resolutions that the Council tackled regarding the issue: that on April 16, 2002, an urgent petition dated April 12, 2002 was received by the Council; on April 18, 2002, Resolution No. 288, Series of 2002, was taken up by the Council as referred by Council Correspondence No. 02-476 to the Office of the City Mayor; that on December 5, 2002, the Council took up Resolution No. 938, Series of 2002, referring to the Office of the City Engineer through the Office of the City Mayor, Council Correspondence No, 02-1369, RE: Letter of Consuelo Development Corp. addressed to the city mayor, copy furnished the council, bringing to her attention the problem of the residents of Villa Valderrama, Bata Subdivisions, Purok Sawmill, Sto. Rosario and Kametal regarding the recurrence of flood in their areas; In Council's Resolution No. 288, it stated "referring to the Office of the City Mayor Council Correspondence No. 02-476, RE: Joint petition of the residents, homeowners and business establishments of Bata Subdivision, Villa Valderrama Subdivision, Purok Sawmill 1, 2, 3 and Puroks Sto. Rosario and Kametal, asking for the immediate removal of the alleged obstruction illegally and maliciously made by Ramon Lacson, Jr. on the main drainage canal at the road leading to the Rose Lawns Memorial Park in Bata Subdivision, purposely to block and close the drainage canal and cut off the outlet of the waters leading to Banago Creek.

Earlier, two investigators from the Department of Interior and Local Government (DILG) conducted an ocular inspection in Barangay Bata where the obstruction in the drainage system was demolished for being a public nuisance.
