Ombud orders dismissal of village head

THE Office of the Ombudsman-Visayas ordered the dismissal from government service a village head of Sto. Rosario, Binalbagan town.

Found guilty for dishonesty and oppression was Rolson Rodriguez whose benefits were ordered forfeited and was disqualified to hold public office.

Deputy Ombudsman for the Visayas Primo Miro also approved the recommendation of Director Edgardo Canton that Rodriguez' Civil Service Commission's eligibility be forfeited.

Rodriguez was charged with administrative complaints for abuse of authority, dishonesty, oppression, misconduct and neglect of duty which were filed by Mercedita Herrera, Jose Tamayo, Efren Tumbagahan, Ma. Luz Paredes and Ferfedia Tumbagahan.

Graft Investigation and Prosecution Officer Corazon Carillo, who conducted the investigation, in her order dated September 21, said of the five charges Rodriguez was found guilty for dishonesty and oppression, while the other charges will be used as aggravating circumstances.

Carillo said based on the Omnibus Rules of the Civil Service, dishonesty is a grave offense punishable by dismissal even if in the first offense.

Based on the Herrera's complaint, Rodriguez purposely ran over the water pipe in her yard with his pick-up truck.

Not contented, Rodriguez attempted to hit Herrera with the disconnected water pipe and went after her when she ran away from him.

Rodriguez was allegedly angry with Herrera because she stood as witness by a complaint filed against the village head for destroying the fence of a neighbor.

Tamayo, on the other hand, was a barangay tanod under the administration of Rodriguez from January to February 2003.

He claimed that despite his resignation his name was still included in the payroll for the months of March and April. Worse, he said, an unidentified person signed to get the salary in his behalf.

When he verified, Rodriquez admitted taking the salary but he (latter) put it in a trust fund.

But during the conduct of investigation, Rodriguez failed to present a deposit slip or the bank book to back his claim.

Carillo said the fact that Rodriguez signed the payroll under the name of Tamayo and made it appear that the allowance was duly received was an act of dishonesty.

On the other hand, Tumbagahan complained that Rodriguez contacted him to construct a 250-meter canal along Jesusa L. Yulo Subdivision, Barangay Sto. Rosario.

The provincial government awarded the project to Engr. Rolando Lima, a contractor, which was sub-contracted to the village head for P9,000.

But Rodriguez negotiated with Tumbagahan to construct the canal for a price of P7,000 and promised to pay the balance upon the completion of the project.

Four months has passed but Rodriguez still refused to pay the balance on the ground that when the province' engineer inspected the canal, it has thin flooring.

Tumbagahan and Paredes, both barangay health workers for 13 and 15 years, respectively, complained they were terminated from the service without any reason.
