Police, judge at odds in San Enrique over drug case By Ryan B. Lachica
SAN ENRIQUE -- The San Enrique police are objecting about the release order issued by Judge Manuel Limsiaco Jr. of 4th Municipal Trial Court of San Enrique, Pulupandan and Valladolid on alleged drug pusher Noel Pabillario.
Pabillario was apprehended last April 28, 2005 while his order of release was issued July 29, 2005.
But the police are questioning the legality of the said release order and "accused" Limsiaco of manipulating the case through the procurement of the affidavit of the witnesses.
They also claimed that there was no hearing done before the order was issued.
The supposed-to-be-affidavit that will support the police and will serve as testimonial evidence became a counter-affidavit in favor now of the accused, they said.
The counter-affidavit was made by lawyer Robert Juanillo who also served as the counsel of the accused. The police now see it as conflict of interest.
Juanillo, however, admitted that he was the one who made the counter-affidavit of Barangay Captain Jose Quitco and Barangay councilman Lever Sancho, who served as witnesses to the search and seizure operation of San Enrique PNP, but defended that what he did was just an act of good faith.
He further said he is only protecting the rights of the accused.
He further said in order to avoid putting color into the issue he endorsed his client to lawyer Freddie Gelbor.
He, however, does not even know that Pabillario was already released from jail.
Juanillo also said the witnesses presented their counter-affidavit to the chief of police before signing them.
Limsiaco, on the other hand, said he saw many lapses in the part of the San Enrique police and favored the application to bail of the accused.
He also added that the counter-affidavit of the witnesses only affirmed the statements of the accused.
