Reinstate Solinap: Commission order

THE Civil Service Commission for Western Visayas ordered Bacolod City Mayor Evelio Leonardia to allow Jerome Solinap to report back to the City General Services Office.

In an order dated February 6, Civil Service Commission director for Western Visayas Imelda Abueghas granted the appeal of Solinap for his reassignment as General Services Office head.

Abueg designated the Civil Service Commission-Negros Occidental Field Office to monitor the implementation of this decision.

Solinap, in an interview, said he is happy of the decision.

"I am very grateful of the outcome because I've been waiting for this about a year and four months. I would have not questioned the order of (Mayor) Leonardia if I only saw that my reassignment was not too much," said Solinap.

Solinap stressed that he is a career officer and his reassignment should only be within a maximum span of one year.

"The law is the law. Leonardia can appeal this but his reinstatement should come first. The decision of the Civil Service Commission will stay. I believe that the mayor is a law-abiding citizen and he is expected to follow the said order," Solinap said.

City Legal Officer Allan Zamora, in a separate interview, said Leonardia wanted to conduct an inventory of all the government assets of the City when he assumed office as mayor in 2004.

Zamora said Leonardia had directed Solinap to do the inventory report of the government properties as the head of the General Services Offices.

But when Solinap failed to submit a report within one year, he was ordered to be transferred to the City Mayor's Office.

On the other hand, Solinap said, "I am not an inventory clerk. I am a department head. The inventory falls under the City Mayor's Office...The mayor's order was wrong in the first place."

"Why should I be the one to conduct it when there is a team that could conduct it. I have given the mayor the benefit of the doubt when he ordered my series of reassignments. But it was already too much. I have to stand for my right," he added.

Solinap was previously reassigned to the Office of the City Mayor on July 28, 2004 so as to personally handle the inventory of all the properties of the Bacolod City Government and shall regularly submit a report effective upon receiving the mayor's memorandum.

In March 21, 2004, there was a detail or additional function assigned to him and it's with the City Administrator's Office.

He was tasked to assist the city administrator in concerns affecting markets and other socio economic enterprise units of the city.

In August 2, 2005 or a lapse of one year, Solinap wrote Leonardia, requesting him if he could be allowed to assume his duties and functions as the General Services Office head.

Solinap received a letter from the city legal officer denying his request in August 4, 2005.

The letter said that there was a "sufficient reason to warrant the continued detail of complainant to other officers."

With all the series and continued reassignments given to Solinap, he decided to file a complaint for alleged constructive dismissal against Leonardia before the Civil Service Commission Regional Office.

Zamora, on the other hand, said the Civil Service Commission has not furnish them yet a copy of the decision.

He also said that the mayor might appeal to the decision.
