High school principal, teacher sued for gross negligence

SUMMARY dismissal proceedings were filed against Baguio City National High School (BCNHS) principal Elma Donaal, after the school's parent-teacher association (PTA) president filed another administrative complaint against her and another teacher for alleged gross negligence and for violations of certain provisions of the Code of Professional Ethics for Teachers.

The complainant, Mario Guadaña, said he noted that Donaal and another teacher from the same school allegedly committed these violations when he saw the yearbook of batch 2003, where numerous clerical errors as well as substantive mistakes were seen in the publication.

The yearbook, he said, contained grammatical errors such as "to be an HRM, to be an expert games, to be an engineering, to be a foreign service (and) to be a tourism," when referring to the ambition of graduating students.

Aside from these grammatical errors, he said, other students who were asked about their ambition in life, gave absurd answers such as "to be a boldstar/porno star, to be the most wanted criminal in the world (and) to be a terrorist," among others.

Guadaña said Donaal, as well as the adviser who caused the preparation of the yearbook, should have looked into and checked its contents before having it printed.

"By the acts and the omissions of herein respondents, as trustees of the cultural and educational heritage of the nation, (they) failed to fulfill their obligation to transmit to the students the heritage of the nation and likewise failed to elevate national morality and promote national pride by allowing the printing and publication of the subject yearbook."

He stressed, "it is not the policy of the State to encourage students to become boldstars, porno stars, terrorists and the most wanted criminals in the world."

But Donaal denied having any hand in the preparation of the yearbook.

She added that while she had been designated as its consultant, she never had anything to do with the preparation of the yearbook.

"Parents and teachers ang nagtrabaho diyan."

She explained she was named as its consultant, only as a matter of courtesy, given her position as the school's principal.

"I was named as consultant, but I was never consulted. I have nothing to do with that."

"Had I known that it would come out that way, I would have been the first one to call the attention of the adviser," Donaal said, adding she only saw the yearbook, after it came out of the printing press.

Due to the errors committed, Guadaña asked that the P280,000 spent for the printing of the yearbook be reimbursed to the parents of the graduating class of 2003.
