PB upholds legality of La Trinidad tax code
AFTER several consultations and dialogues with affected parties, the Provincial Board (PB) of Benguet has sustained the legality of La Trinidad's tax ordinance.
In a resolution, the PB said La Trinidad's 2005 Revised Revenue Code has complied with provision of the law, particularly the Local Government Code. "This body finds that the municipality has substantially complied with provisions of Sections 187, 188 and 511 of the Local Government Code (LGC)," the PB said.
The provisions mandate that municipal tax codes shall undergo the process of public hearing and shall be published prior to its implementation.
The PB however advised the Municipal Government to make some adjustments to local fees that are complained by some businessmen to be excessive.
"While this body recognizes the propriety powers of the municipality, it expresses doubts on the fairness and reasonableness of some fees and charges imposed, understanding that fees and charges are suppose to commensurate with the cost of regulation, inspection and licensing," said the PB.
Traders at the vegetable trading post earlier challenged the legality of the municipal tax code, claiming it did not comply with the requirement of publication and that the fees imposed are excessive. The town published the ordinance late March.
They also asked the court to issue an injunction against the code's implementation and requested the PB not to give a favorable review of the ordinance. The court has yet to issue a final decision on the injunction suit. (JC)
