THE Office of the Solicitor General (Solgen) was asked to investigate the alleged overlapping of properties covered by Original Certificate of Title (OCT) I.
Penned by Councilors Fred Bagbagen, Betty Lourdes Tabanda, and Isabelo Cosalan Jr., the proposal aims to address the encroachments found in separate surveys done by the Department of Environment and Natural Resources and the City Assessor's Office.
It was discovered that the titles issued to SM Baguio, the Government Service and Insurance System (GSIS), and heirs of Carantes encroached OCT I, which is registered in the name of the National Government.
The proponents said if the Solgen finds these titles overlap with OCT I, the transfer certificates of title should be rescinded.
Discrepancies on OCT I was earlier brought up, after members of the City Council learned about SM's plan to develop the pine stand near the Baguio Convention Center.
Cosalan said the GSIS title appears to have overlapped with OCT I. In such cases, he said the original title should prevail.
