Flak against Buguias tax code continues

OPPOSITION against Buguias' new tax ordinance continues, despite the local government's assumed compliance with the requirements in the passage of the measure.

Marcelino Bul-long, one of the petitioners against the 1998 municipal revenue code, moved for the disapproval of the revised code, in the meantime the request for nullification has not yet been resolved by the court.

In his letter to the Provincial Board, Bul-long requested for the disapproval of Buguias' 2008 tax code to avoid future conflicts between the legislative body and the judiciary.

"If a law sought to be amended or revised is invalid being null and void from its inception, then it does not legally exist and there should be no occasion or need to revise it," Bul-long said.

He made the letter in behalf of the petitioners who questioned the legality of the town's 1998 tax ordinance.

The local government started implementing the revised revenue code October 1, after complying with the required publication.

The 1998 tax ordinance was questioned in court for having failed to undergo publication and posting as required by law, aside from the petitioners' claim fees imposed under the ordinance are excessive.

Under the Local Government Code, municipalities must submit to their respective provincial councils their budget for review. (JC)
