Piso lots can't be purchased: Emano
MAYOR Vicente Emano said his political rival, former vice-mayor Atty. Antonio Soriano, was wrong in saying that "piso-piso" landowners can sell or mortgage their lands because they have already paid P1 per land title.
"Wala lang siya makakita sa kontrata anang sa Piso-Piso nga dili gayud pwede ilang iprenda o ibaligya ang yuta (Soriano just didn't see the contract between the government and Piso-Piso land beneficiary and it is stated there that Piso-Piso land could neither be mortgaged nor sold)," he said over the radio Saturday.
But Soriano, a private practicing lawyer, said the law provides that items sold to any person for any agreed amount, no matter how small, can be mortgaged or sold by the new owner.
Soriano said the law provides that once a person sells his property for whatever amount he can no longer have any control of that said property and that the buyer can do what he wants with it.
He then quoted the piso-piso Ordinance approved by the City Council that provides that the government land would be sold at P1 per land title to the Piso-Piso beneficiary.
"There is such an amount as P1 per title that is set as payment by the Ordinance. This means the land is now legally bought by these piso-piso beneficiaries thus Emano or anybody in the government can no longer dictate the people what to do with the land they bought," he said.
"This is what I have been saying all along that should we help out people we should make sure that we really push it through not that we pose conditions on them and take advantage of them," he added.
Donation
But for Emano, allowing Piso-Piso beneficiaries to mortgage or sell the lands the government gave to them would result to a major disaster.
He said the indigent beneficiaries who bought the land at P1 each title would be tempted to sell or mortgage their lands below its exact assessment value.
"Several rich people would buy off their lands and those indigents who have availed of this Piso-Piso would lose their lands," he said over dxCL Angel Radyo last Saturday.
Emano said the city's coffers would run out of money should the Piso-Piso beneficiaries be allowed to sell or mortgage the land titles given to them by the government.
"Sige nalang dayon ug palit ug yuta ang gobyerno unya sige baligya sa katawhan (The City Government would just keep on buying lots while the people keep on selling them)," he said.
Soriano explained that the only way for Emano to put conditions on the Piso-Piso land titles he supposedly distributed is to give it out as a form of donation to the people.
He said it is only Deeds of Donations that carries with it stipulations from the original owner that the property donated can neither be mortgaged nor sold not Deeds of Sale.
He said if Emano wants to put conditions that the land title should never be sold nor mortgage by the Piso-Piso beneficiary, this is against the City Council's ordinance.
Warning
However, a check with City Hall yesterday revealed that there is no such thing as a Deed of Sale at P1 each title issued to even a single Piso-Piso Land Program beneficiary nor even a Deed of Donation.
Soriano said he isn't surprised that there is no such thing as a Deed of Sale at P1 each title issued to a single Piso-Piso supposed land title holder.
He said Emano would never allow the beneficiaries of the Piso-Piso to escape from his grasp.
"For should Emano give the land titles and Deed of Sale to these Piso-Piso land beneficiaries then these people would no longer be loyal to him and Emano would no longer have anything to use in manipulating these people," he said.
Should they be chosen by the people to replace the current adminstration, Soriano said they would allow Piso-Piso beneficiaries to sell or mortgage the land.
But this time it would come with a warning that should they lose their Piso-Piso land title they would not be given a chance to get into another government relocation site.
"Should these Piso-Piso landowners sell or mortgage their lands they should bear in mind that should they lose the land title given to them they won't be able to avail of any government land program or be allowed to be get into another public relocation site)," he said.
He said they would also study further the Piso-Piso Ordinance to make it fool-proof. LJA
