Dacer: Rape suspect claims he's incapable of sex

"THAT is impossible, mine is no longer functional."

Association of Barangay Council (ABC) chairperson Alexander Dacer so quoted a barangay official who is currently facing a rape complaint.

Barangay chief Ervin Pacheco of Barangay 32 was positively identified by a 15-year-old elementary pupil as the one who sexually abused her five times.

The complainant is a daughter of a trisikad driver and a barangay police of the said barangay.

Dacer said he already talked to Pacheco and the latter told him the allegations against him are simply untrue since he suffers from erectile dysfunction.

Dacer said Pacheco's statements might be true since the latter is diabetic. A person suffering from such ailment is said to have difficulty if not incapable of sexual intercourse.

According to Dacer, Pacheco told him that he no longer experience erection because of his diabetes. He at the same time told Pacheco that he better prove that in court.

The suspect is reportedly one of the closest allies of City Mayor Vicente Emano during the election.

Minor

It was learned that prior to the charges Pacheco was fond of giving money to the victim.

The complaint was already forwarded to the prosecutor's office.

Pacheco was given 10 days to answer the allegations before it would be arraigned in court.

"If I will borrow the statement of Kobe Bryant, a National Basketball Association (NBA) player who was also accused of rape, the latter's defense was consensual, but that of Pacheco is different as the victim is a minor, Dacer said.

Dacer said an investigation concerning the case is still ongoing at the ABC. He said if the allegations would be proven to be true then Pacheco would be dealt with accordingly.

A hearing was already scheduled at the ABC office in order for the suspect to give his side.

The ABC president said an action should be made against Pacheco if he would be found guilty as it could tarnish the image of some barangay heads.

In her sworn statements, the victim said the suspect allegedly abused her five times inside a separate motels located at Barangays Patag and Bulua here.

According to the victim the series of incidents happened last August 4 and 24; September 8, 17 and 21, this year.

The complainant said the first three incidents happened at Kilometer 3 Inn located at Barangay Bulua. While the last two occasions occurred at City lodge located at Barangay Carmen.

She narrated in the same affidavit that prior to the incident the barangay official picked her up at the school with the latter's vehicle with plate number KBC-524.

She said the suspect then brought her to the said motels where she was sexually abused.

She said every time he used her the suspect would gave her P500 cash with a warning to tell the incidents to her parents or to anybody.

The victim's mother only knew the sexual abuses last October 7 thru her closed female friend.

The mother said her daughter confirmed to her everything during a confrontation and she accompanied her to the police precinct number for a blotter.

A medical examination at the Northern Mindanao Medical Center (NMMC) showed that the victim has healed lacerations.

Sun.Star Cagayan de Oro went to the suspect's house and office only to be told that the suspect was not around.

The prosecutor's office gave Pacheco 10 days to submit his counter affidavit. (With a report from Sun.Star Superbalita)
