Radio station eyes P1M suit v. Valencia execs By Joey P. Nacalaban
THE City Government of Valencia would be sued P1 million for its order to close down Radio Mindanao Network (RMN).
RMN lawyer Rogelio Bagabuyo said the station would file a damage suit against Valencia City through Chief Executive Jose Galario for ordering the radio station closed last September.
Galario was the subject of criticisms by Joas Dignos, anchorman and manager of DXVR, the sister station of DXCC in Cagayan de Oro.
Dignos especially lambasted Galario on the series of killings in their area allegedly perpetrated by a group called Anti-Drug Advocates. Galario denied the allegations.
The commentaries irked the mayor and led to the passage of an ordinance by the Valencia City Council to close the station and revoked its permit to operate.
But fortunately RMN management was able to get a temporary restraining order from the court.
Judge Josefina Gentiles Bacal of the Regional Trial Court Branch 10 then issued a status quo order in favor of RMN.
Bagabuyo said the issue on whether the ordinance is lawful or not is already moot and academic considering that the court has ordered a status quo until the case would be resolved.
"Wala na kanay nada kay karong Enero mag renew naman pud ang RMN sa ilang licensya sa syudad. Kinahanglan ila gyud nang i-renew kung dili sila gusto duna na puy laing kaso ilang atubangon," Bagabuyo said.
Bagabuyo said that what his client and Galario's group would be arguing is on how much the latter would pay as damages as result of the closure order.
He said he would be asking P1 million as payment for damages.
Engineer James Jadormio, RMN area manager, told Sun.Star Cagayan de Oro that Galario's order caused their station to sustain losses after a lot of their would-be advertisers shied away from putting their advertisements for fear that it would be closed.
Bacal, during the meeting last Thursday, requested Bagabuyo and Valencia legal counsel Abraham Oligario to submit their pre-trial brief on January 19 next year.
RMN supporters who came all the way from Valencia City and other parts of Bukidnon to stage a rally attended the meeting.
