THE Regional Trial Court (RTC) recently junked the petition of defeated mayoralty candidate Carousel Borromeo to sit as mayor for the municipality of Balingasag.
Borromeo filed the petition after the RTC nullified the results of the May 14 elections in Balingasag and quashed the promulgation of Quina last February 6.
There was no immediate comment from Carousel Borromeo or from her lawyers yet.
Judge Jose Escobido of RTC branch 37 in its nine-page decision penned last February 18 pointed out that Quina filed a notice of appeal well within the prescribed period allowed by the rules of court.
"Giving due course to Quina's appeal, the court deemed it proper to deny Borromeo's motion for execution," Escobido said.
Escobido also ordered all records and evidences of Borromeo's complaint to the Commission on Elections (Comelec) Electoral Contests Adjudication Department.
However, Escobido denied with finality Quina's appeal to reverse its decision last February 6.
Escobido noted that the decision appealed by Quina was not yet final and executory.
According to Quina, he welcomed the latest court decision, but added: "this fight is far from over."
"The next battleground would be in the Comelec. We hope for a final judgment on this case so that we can all focus on serving the public," he said.
