Preliminary investigation on Bacal's case set

THE preliminary investigation of Councilor Alden Bacal's vehicular accident is set Monday by the City Prosecutor's Office, but the councilor is undecided whether he would attend or not.

"I still do not have any idea, my lawyer have not inform me yet," Bacal told Sun.Star Cagayan de Oro.

City Prosecutor Fidel Macauyag had scheduled the preliminary investigation on Bacal's vehicular accident, which resulted to the death of 15-year-old Junrie Balingit last July 10.

Aside from Councilor Bacal, Macauyag also summon the parents of Balingit, Acting City Police Director Isagani Genabe Jr., Police Inspector Rogelio Bonggo, traffic director and traffic investigator SPO2 Rogelio Borromeo.

Lawyer James Judith said he will attend the investigation since the parents of Balingit, who took him as counsel at the onset, did not formally sever his services.

The parents of Balingit, Gerardo and Regie, have already filed an affidavit of desistance against Bacal, saying they are no longer interested in pursuing the case against the Councilor.

Judith said Gerardo and Regie complained to him that Bacal allegedly did not give them the promised payment of P200,000. He said the parents of Balingit allegedly only received P100,000 from Bacal.

He said the couple came to his office last Wednesday about their new complaint against the councilor.

"Nireklamo pud si Gerardo kay hangtod kuno karon wala pa sila hatagi sa balance sa nauyonan nga payment sa settlement," Judith said.

Bacal declined to comment on this when Sun.Star Cagayan de Oro interviewed him last Sunday.

Judith urged Bacal to attend Monday's investigation otherwise he will be forced to file a motion for his arrest.

The police are expected to present their evidence Monday that will prove the criminal liability of the councilor. (ALR)
