City Hall told: Release P25M immediately By Gingging A. Campaña
THE heir of a property in Sitio Ipil-ipil, Barangay Capitol Site that the Cebu City Government is expropriating is asking City Hall officials to release the P25.56-million payment immediately.
Patricia Palicte-Perez, in her March 21 letter to the City Council, reminded the City Government of Regional Trial Court (RTC) Judge Simeon Dumdum Jr.’s ruling fixing just compensation for the property at P4,500 per square meter.
The City, exercising its power of eminent domain, filed a petition in court to get hold of the 5,285-square-meter property of Matilde Sotto-Palicte on Nov. 21, 2001 before the court, after the City Council passed Ordinance 1920 as an emergency measure supporting the move.
This was to make good Mayor Tomas Osmeña’s 2001 election campaign promise to the 200 informal settlers, who have been occupying the property for 20 years, to relocate them once he is in office.
Perez said Dumdum issued another judgment dated March 14, 2003 fixing the just compensation for the property at P4,500 plus six percent interest per annum starting last Dec. 4, 2001.
The City is supposed to pay only P23,782,500 (P4,500 X 5,285 square meters), but add this to the six percent interest from Dec. 4, 2001 to Dec. 4, 2002 ,which is equivalent to P1,426,950, then City has to settle P25,209,450.
If an interest of P356,737 is to be added for January to March 2003, then the City owes the Palictes some P25,566,187 for the entire property.
