Priest sued on land deal

A ROMAN Catholic priest was accused of falsification of public documents before the Cebu City Prosecutor’s Office, over six hectares of land in Barangay Marigondon, Lapu-Lapu City.

Fr. Agustin Nazareno allegedly submitted a forged special power of attorney and a forged deed of absolute sale so that a lot title could be issued in his name.

But his mother Linda Nazareno denied that her son had anything to do with it, since it was she who contracted an agreement with complainant Dominga Juarez sometime in the 1980s.

“I just placed the name of my son in the title but it was I who bought the property a long time ago. My son, who is both a lawyer and a priest, has nothing to do with this. In fact, he warned me not to deal with her (Juarez) because the lots she sold to me have no titles,” Linda said during a phone interview.

Spared

The 82-year-old Nazareno, widow of the late Col. Jose Nazareno, requested that her son be spared from the case.

“Why won’t she sue me instead? I’ve had enough of her. I’m already very old. She has fooled me several times,” she added.

In her complaint, Juarez said she and her sister, Agripina Jimenez, are co-owners of Lot 3188, covering 6,935 square meters, in Lapu-Lapu City.

She recently found out about a “forged” special power of attorney, notarized by lawyer Agueda Monteclar, now clerk of court of Regional Trial Court Branch 24, and a “forged” deed of absolute sale notarized by lawyer Leonardo Garcillano.

“I was greatly surprised and in categorical terms deny that I had executed a deed of absolute sale in favor of (the priest),” Juarez said in her complaint.

Forged papers

She added that her sister, now deceased, did not sell either.

“Her name merely appeared as one of the registered owners but in truth and in fact the entire lot is owned by me,” Juarez said.

It was allegedly through the forged documents that the ownership of the lot was transferred and a new title was issued.

But Nazareno said the lot in Barangay Marigondon is just one of the many lots Juarez had sold to her.

“There was even one that she sold to another after selling it to me. This is why I already refused to see her. My son has also warned me not to buy more lots from her because these were not covered by titles,” she added.

When she had the property titled, she placed it in the name of her son, a former member of the Jesuit community and now a “secular priest” and lawyer, specializing in labor laws in Cotabato.
