CH tightens watch on building works By Rose O. Verzosa
TO PREVENT accidents, the Lapu-Lapu City Council passed an ordinance regulating the construction and repair of buildings, houses and other structures.
The Office of the City Attorney recommended the passage of the ordinance following its observation that the number of illegal and unsafe structures are increasing in Lapu-Lapu.
“This proposal was arrived at by this office after consultations with the other concerned departments regarding the proliferation of illegal and unsafe structures.” City Attorney Vincent Joseph Lim said in his endorsement to the City Council last Dec. 2.
“(The structures) not only threaten the safety and security of the constituents of our city but also tend to undermine the development and progress that this City is painstakingly trying to achieve continuously,” he added.
The ordinance provides that buildings, houses, fences, concrete walls, dikes, causeways, wharves and other structures not passed upon and issued permits are declared “illegal and nuisance per se.”
All reclamation, demolition and backfilling activities that do not have the City Government permit are also declared as nuisance.
Owners will be given 10 days to remove the structures before the City will resort to its demolition. The city mayor is authorized to remove, destroy or demolish the illegal structures.
If such nuisance should prove to be injurious to the health of the community or cause damage to the environment, an imprisonment and fine will also be meted on the owners, proprietors, lessors or managers of the structures.
First offense is punishable by a P2,000 fine or a one-month imprisonment, while a second offense is punishable by a P5,000 fine or three-month imprisonment. Succeeding offenses are punishable by a fine of P7,000 or an imprisonment term of six months.
The expenses for the structure’s abatement will also be charged against the violators.
