Hospital owners offer P40T bond for court to lift injunction v. them

THE owners of St. Vincent General Hospital and St. Vincent College are asking the court to reconsider its injunction order against them.

In a motion for reconsideration, Vincent and Annie Taboada, and Nancy and Danny Yu said they are willing to put up a bond of P40,000 just for the injunction order to be lifted.

“Unless reconsidered by this court, a temporary restraining order/injunction will cause (the owners) to suffer grave and irreparable damage to its rights and property,” the motion read.

Unfair

The owners’ lawyer, Mario Ortiz, said it was unfair for Regional Trial Court Branch 12 Judge Aproniano Taypin to issue the injunction order without them during the hearing.

Dr. Editha Vasquez, for her part, denied she was barred from entering the premises of the two institutions.

She said she only testified in court about the harassment committed by the owners and their representatives when the relationship between them and the doctors turned sour.

Earlier, the RTC stopped the owners of St. Vincent General Hospital and St. Vincent College from taking away the equipment and facilities from the two institutions.

Civil suit

This, after the Cebu United Doctors Inc. filed a civil suit and alleged that they have an agreement with the owners of the hospital and school that their organization shall be given a free hand in running the two companies.

In the agreement, the owners would reportedly provide the equipment, instruments, fixtures, facilities and building for the business, while the doctors take charge in the operation.

But the owners allegedly conspired in harassing the doctors in the hospital, located in front of the Cebu City Sports Center near Osmeña Blvd.

Taypin also indicated in his order that the owners should not take the funds of the joint venture, as well as the revenues and earnings of the hospital and the college.

Ortiz said the owners banned two doctors from using some expensive equipment due to their alleged incompetence and gross negligence, which caused the damage of a sterilizer.
