Council clears way for purchase of P4.1M road

THE Cebu City Council approved the purchase of the existing road that connects Banawa to Ba-rangay Labangon despite road right-of-way problems dogging the P4.11-million property.

Opposition Councilors Carmelita Piramide, Dana Ruiz-Sesante, Danilo Fernan and Eugenio Gabu-ya Jr. objected to the passage of the resolution authorizing Ma-yor Tomas Osmeña to sign an agreement with the Dypicos and Uychongcos for the purchase.

Piramide said there is a need to look into the property because she believes it is the same one that has already been made a road right-of-way of another property.

Original owners

When the property was sold by the original owners to the Dypicos in 1996, she said “an encumbrance was attached to the title of the lot, annotating that it is a perpetual road right-of-way to another property.”

This means that the said property is already marked as road right-of-way of a certain lot adjacent to it.

“You can never sell or transfer a perpetual road right-of-way and I don’t know if between 1996 and 2002 there was a cancellation of the encum-brance,” she told the council last Wednesday.

Administration Councilor Procopio Fernandez suggested to the council to consider the observations.

Initial payments

But Councilor Gerardo Carillo said it is a different property, initial payments have been approved and that urban poor residents in the area will be able to use this road.

“The City Attorney’s Office acted favorably on the matter and that the City Budget Office certified that there is no other road right-of-way available,” he said.

A P2.05-million payment will be initially released to the owners upon signing the deed of absolute sale and the remaining P2.05 million will be paid after the certificate of title is transferred to the City’s name.
