Ruiz dared to sue CH over donation By Rose O. Verzosa
FORMER mayor Alfredo “Pedong” Ouano took offense to the statement of Joselito Ruiz, Alayon’s candidate for vice mayor, that the Mandaue City Government’s donation of a 9.2-hectare lot to an urban poor group is a sham.
Ruiz admitted that he warned the public during a radio interview last week not to believe in the donation because it is “impossible” to happen, considering that the property involved is a prime lot.
The Ouano administration always brandishes that donation every election period but it has never materialized, said Ruiz.
“If he believes that the lot titles are fake, then he should sue the City Government,” said Pedong, who facilitated the donation during his incumbency.
Pedong said the Federation of Mandaue City Urban Poor Inc. (Fedmacupi) now owns the lot and it is up to the group to subdivide the lot among its members, who are the lot’s actual occupants, and have it titled under their own names.
Statements
Mayor Thadeo Ouano, for his part, said Lito’s statements only showed his lack of knowledge on the matter.
On Feb. 4, 1998, the City Government, through Pedong, executed a deed of donation transferring and conveying ownership of the land, which is covered by two land titles. The lot traverses Barangays Centro, Mantuyong, Guizo, Tipolo and Subangdaku.
The transfer of ownership of the lot was spoiled, though, following the refusal of the two
priests of San Roque Parish in Subangdaku to turn over to Fedmacupi the owners’ duplicate certificates of title, the original donation of real property inter vivos and other documents concerning the donated lot.
The officers of Fedmacupi had delivered the documents to Rev. Fr Venancio Lacorte and Rev. Fr. Mario Castillo for safekeeping. But the two priests refused to return them because several urban poor groups whose members are also beneficiaries of the lot do not favor Fedmacupi’s moves.
Civil case
This even led Fedmacupi to file a civil case against the two priests.
Last year, the Court of Appeals affirmed the decision of the Regional Trial Court (RTC) directing the two priests to turn over the land titles and other documents to Fedmacupi.
If they fail to comply with the order, the owner’s duplicate copies of the two transfer certificates of title, which are in their possession, are declared null and void and the Register of Deeds will be ordered to cancel them and issue new ones.
Since the priests failed to return the documents until now, the court nullified the two lot titles and ordered the issuance of new ones, said Pedong.
He will check with the Register of Deeds whether the lot’s new titles under the name of Fedmacupi were already issued to the group.
