Talk back: No misrepresentation By Gloria Lastimosa- Dalawampu Legal Counsel Inchemcoat Phil., Inc
This is a reaction to the paid advertisement of Nicholas Wu and Intelchem Phil., Inc. (IPI), which imputed to my client, Inchemcoat Phil., Inc. (Inchem), the commission of illegal business transactions.
We hope this reaction is published to correct whatever distorted opinions on Inchem the public may have because of the unfounded accusations of Nicolas Wu and IPI.
The “Notice to the Public” that came out in the April 5, 2004 issue of Sun.Star Cebu accused Inchem of misrepresenting itself as a “sister company” of IPI and of allegedly securing credit terms with IPI’s suppliers and creditors, or special accommodation from IPI’s business partners.
Nicholas Wu and/or IPI also maliciously accused Inchem of allegedly spreading rumors that IPI is closing its business so Inchem can take over IPI’s customers.
Nicholas Wu and/or IPI knew very well that these are false, baseless and malicious accusations. Inchem has, at all times, been conducting itself as a legitimate business company in sound, healthy and friendly competition with other companies, including but not limited to IPI.
In the “Notice,” Nicholas Wu and/or IPI explicitly pointed their finger at Inchem. Consequently, Sun.Star readers are made to believe Inchem is guilty of certain offenses. The words used in the publication are sufficient to impeach Inchem’s honesty, virtue, and reputation and were clearly meant to put Inchem to public ridicule.
Definitely, this is libel.
Nichaolas Wu and/or IPI know very well that Inchem did not commit any act of misrepresentation as imputed in the publication. But if they can present solid proof, Inchem itself will weed the employee concerned out of the company.
In this connection, we demand that Nicholas Wu and/or IPI present to us sufficient and solid evidence to bolster their accusations. If they fail to do so within five days, we shall consider their paid advertisement as part of their sinister design to force Inchem to pull its business out of the Philippines, thereby leaving them conveniently transacting business without any competitor.
