Counsel of vice governor to face disbarment case

THE camp of Gwen-dolyn Garcia will file within this week the disbarment case that they have been planning against lawyer Edgar Gica.

Pablo John Garcia, Gwendolyn’s legal counsel and brother, announced this in a press conference
yesterday after finding out about Gica’s intention to file a petition for disqualification against his sister in behalf of a supposedly secret client.

Unethical behavior

“Nganong secret man iyang client? Nauwaw nga siyay abogado (Why is the client secret? Is the client ashamed that he has him for a lawyer)?” said Pablo John, who will cite Gica’s “pattern of unethical behavior and cases filed only because of malice.”

Earlier, Cebu Gov. Pablo Garcia vowed to work for Gica’s disbarment after his third term expires on June 30.

Gica had worked for Vice Gov. John Gregory Osmeña, Gwendolyn’s rival in the race for next governor, during the canvassing and in several previous cases.

Disqualification

A report had said Gica was set to file a disqualification case, although Osmeña earlier said he himself was not pursuing it.

Gica could not be contacted yesterday through his mobile phone.

In a talk with reporters, Pablo John said Gica’s move to have Gwendolyn disqualified shows “personal malice.”

It’s apparently a nuisance, filing a case without sense, Pablo John said.

He added that this would be a violation of the lawyers’ oath and is a ground for disbarment.

The case will be filed before the Supreme Court, which may “delegate the task of receiving evidence.”

The idea to disbar Gica first came up when he assisted the filing of cases against the governor and his daughter for “masterminding” the release of around P5 million to Perdido Lex Foundation, a bogus foundation.

The governor called the case, which was for technical malversation of public funds through conspiracy, “the wildest and stupidest case concocted by a bum lawyer.”

‘Malicious’

Pablo John said he will cite this “malicious persecution” in the case they will file against Gica, which will also include his “unethical behavior” by representing Osmeña in the provincial canvassing while doing other things for Osmeña’s rival, former congressman Ce-lestino “Junie” Martinez Jr. JPM
