Alternative dispute solution urged

PHILIPPINE Chamber of Commerce and Industry (PCCI) chairman Sergio Ortiz is calling on businessmen in Cebu to start reuniting “a deeply fractured nation” by making use of alternative dispute resolution (ADR).

In a speech read by Philippine Exporters Confederation Inc. project manager Gerry Anigan during the launching of the Cebu Chamber of Commerce and Industry’s (CCCI) business conflicts mediation system, Ortiz said ADR fosters unity in the country and businessmen.

Republic Act 9285 or the Alternative Dispute Resolution Act of 2004 defines ADR as any process used to resolve a dispute or controversy, other than by adjudication of a presiding judge or a court or an officer of a government agency.

Ortiz hailed the CCCI’s effort of institutionalizing ADR through its conflict mediation system, saying Cebu is again way ahead of the other business communities in the country.

The CCCI, together with the Cebu Mediation Foundation Inc. (CMFI), undertook the P1.2 million business conflicts mediation institutionalization project last January primarily to assist the Cebuano community in increasing its awareness of the advantages of using mediation and other ADR methods in resolving conflicts in business.

Six months after the project was started, the CCCI and CMFI launched the system, which signals the start of the pilot phase of the project’s mediation desk unit, CMFI president and chief executive officer Bonifacio Belen said.

The mediation desk unit will receive disputes, assign mediators and conduct mediation sessions, he said.

Any interested party may file a request for settlement conference with the mediation desk coordinator. Cases eligible for mediation include collection, ejectment, claims for damages, easement cases, cases involving property, construction, commission and breach of service contract. JBN
