Micame: Power to fix local officials’ salaries

INTERPRETATION NEEDED. Mandaue City Vice Mayor Amadeo Seno Jr. faxed me a copy of a letter dated Sept. 28, 2004 which he and the other members of the City Council had sent to the Commission on Audit (COA), reiterating their demand for interpretation of Section 81 of Local Government Code. Actually, the Sept. 28 communication was the third one. The City officials had sent COA a letter of the same nature on Sept. 17, 2003 and another one last Jan. 14. The City officials wanted a clear interpretation of the said provision because they have been collecting their salaries and other benefits based on the said provision.

“But we find it unfortunate that your office continue to insist on the Joint CSC and DBM Circular 1, s. 1990 and the other joint circular s. 1991 as the basis in withholding the application of Section 81 of the Local Government Code and Article 77 of the Implementing Rules and Regulations, rendering it nugatory and ineffective,” the letter said.

The legislators pointed out that when Congress enacted the Local Government Code, it granted the local government units (LGUs) the power to fix the compensation for local officials and employees.

Why is COA hesitant and afraid to give clear interpretation of Section 81?

TRADE FAIR. Twenty-one commercial establishments in Cebu will participate in three-day Industrial Fair and Trade Exhibit which opens at the old public market along the National Highway in Consolacion starting today.
