NBI to investigate V. Gullas shooting

THE shellcraft worker who was killed on V. Gullas St. late Sunday night was shot 10 times, prompting the National Bureau of Investigation (NBI) 7 to look into the case.

The NBI has autopsied the body of Jovigis Garde.

Garde, in what was described as a drunken rampage, allegedly engaged policemen from the Waterfront precinct in a gunfight with a newly bought .38 paltik revolver.

“The police is saying that it was a legitimate encounter but the number of gunshots appears to necessitate a closer scrutiny,” said NBI 7 Executive Officer Nelson Bartolome.

In an initial report prepared by the NBI medico-legal officer Rene Cam, Garde had four gunshot wounds in the lower extremities, two gunshot wounds in the abdomen, two wounds in the chest a graze wound in the buttocks and another graze wound in the right cheek.

While his men face investigation, Chief Insp. Marciano Batiancela Jr., head of the Waterfront Police Precinct, yesterday ordered the filing of three criminal complaints against Garde’s younger brother Gloven and one Alvino Ordina.

Gloven and Ordina were with Jovigis when the latter was shot dead.

Hoods

In an interview at the Office of the Cebu City Prosecutor yesterday, Gloven denied that his brother shot it out with the police.

He said they were running away from a group of hoods who were chasing them from a spot on S. Osmeña St., where they had been drinking, when they met the squad of policemen.

His brother, Gloven said, had fired a warning shot when the hoods began chasing them and might
have fired off a shot at the policemen when they were cut off on V. Gullas St.

He, however, stressed that they weren’t the ones who fired first.

In a joint affidavit, PO3 Carlito Saberon and PO3 Emmanuel Sarmiento admitted to having shot Jovigis but said it was the suspect who shot at them first. SPO1 Roel del Socorro and PO3 Esmael Gandionco also signed the affidavit.

In their affidavit, the policemen claimed a group of men went to their headquarters minutes before the shooting, saying three drunken men, armed with a handgun and a fan knife, accosted them along S. Osmeña St.

They said they went to the area and were told that the three had already proceeded to neighboring V. Gullas St.

They then proceeded to V. Gullas and, after introducing themselves as policemen, received a volley of gunfire.

They said they retaliated, killing Jovigis in the process.

Findings

The NBI autopsy report shows the trajectory of the wounds going upward—shots in the lower abdomen cut upward into the backside of the chest region.

Bartolome declined when asked to comment on the similarity of Cam’s findings with the findings of previous cases consistent with the victim lying down when shot.

“Further investigation is necessary. We will follow the standard operating procedure. The PNP homicide is handling the investigation. But if there is a formal request from the family, we can take over,” Bartolome said.
