Disputes mediation goes online
* Internet-based service to help in non-confrontational resolution of business conflicts
BUSINESS conflicts can now be settled on the Internet.
This after the Cebu Chamber of Commerce and Industry (CCCI) Inc. and the Cebu Mediation Foundation Inc. forged a memorandum of agreement (MOA) with the Cyberspace Policy Center for Asia Pacific (CPCAP) for the establishment of a web-based service using the non-confrontational approach of alternative dispute resolution.
The agreement seeks to augment CCCI and CMFI’s Business Conflicts Mediation System services by incorporating the online dispute resolution (ODR) mechanism in its current mediation unit, according to a statement furnished Sun.Star.
CPCAP is a non-profit think-tank focusing on the role of government in the information age particularly with respect to issues arising from the intersection of law and technology.
In its agreement, CCCI and CMFI, which launched the Business Conflicts Mediation System project in January 2004, will add the online facility called Philippine Online Dispute Resolution (PH-ODR) service to CCCI’s mediation desk.
Milestone
The current mediation unit resolves disputes by bringing together parties to face-to-face meeting.
“The establishment of PH-ODR within the system will be another milestone as it will encourage more parties to avail of mediation services especially involving business disputes where parties come from out-of-town,” CCCI president Robert Go said.
CPCAP launched the first ODR service in the Philippines, which it developed with the support of the Asia Foundation and Microsoft Philippines, in November last year in Manila as part of its Virtual Multi-Door Courthouse Project.
CPCAP also spearheaded, in cooperation with CMFI, a similar activity in Cebu, highlighting PH-ODR as a new era in dispute resolution.
SMS ready
As partner, CPCAP will train the existing 37 business conflicts mediators of CCCI and CMFI on how to use the ODR facility and how to maximize its services.
The PH-ODR is a pioneering initiative in the Asian region, being the first online dispute resolution in the Philippines or in any developing country. PH-ODR is now up and running at www.disputeresolution.ph. It is also SMS-ready, and will allow access of some functions using a mobile phone once agreements with the mobile providers are put in place. (JBN)
