Petralba to head fiscal’s office in province, Rubia in Talisay

THE Department of Justice (DOJ) has appointed lawyer Pepita Jane A. Petralba as chief of the Office of the Cebu Provincial Prosecutor and lawyer Marshall L. Rubia as chief of the Office of the Talisay City Prosecutor.

Justice Secretary Raul Gonzalez, in a March 29, 2005 memorandum received only yesterday, wrote to Regional State Prosecutor Antonio Arellano and transmitted photocopies of the original appointments that he said have been signed by the President.

Arellano, in an interview yesterday, said he wants the new appointees, which include lawyer Adriano Montes who will head the Office of the Tagbilaran City Prosecutor in Bohol, to appear before him next week so they can be briefed.

The actual assumption to office takes place afterwards.

Both Rubia and Petralba were not available for comment when reached.

Acting Provincial Prosecutor Napoleon Alburo, interviewed yesterday, expressed his readiness to turn over the office to the new appointee “at the most convenient time.”

He said he had prepared himself for the eventuality, pointing out that Petralba’s appointment had been rumored almost a month before.

“There’s nothing more we can do. I’ll revert back to being the 2nd Assistant Provincial Prosecutor as soon as she assumes office,” he said.

Acting Talisay City Prosecutor Mary Ann Castro, for her part, said, “I have not yet received my copy of the memorandum,” she said in Cebuano. She declined to comment further.

Mother unit

With Rubia getting a permanent appointment, Castro will be forced to return to her mother unit, the Office of the Cebu City Prosecutor, which she wants to head.

Castro filed criminal complaints against two of her fellow prosecutors for signing a petition opposing her application over that of Acting chief Nicolas Sellon.

Alburo, in an earlier interview, blames the camp of Rep. Clavel Asas-Martinez and accused them of blocking his application that “had the endorsement” of the Provincial Governor, Regional Prosecutor Arellano and the Justice Secretary, as it reached Malacañang.
Revenge in politics, he said, was the reason.

“My only fault is that I signed the certificate of canvass that led to the proclamation of Gov. (Gwen) Garcia. They told me not to sign it but I could not do that because it was a ministerial duty being the vice chairman of the Provincial Board of Canvassers,” Alburo had said.

He said the Martinezes approached him during the canvassing stage of last year’s poll.

He said they asked that he delay Garcia’s proclamation during the last polls because they had raised a question before the Comelec en banc.

He revealed that the Martinezes cited he is a native of Bogo town and was only able to join the prosecution service in 1987 because of the endorsement of the Martinezes.

Petralba was the lawyer for the Martinez camp during the last poll. (KNR)
