The National Labor Relations Commission (NLRC) yesterday ordered unionized workers of Cebu Holiday Plaza Hotel to stop holding a picket at the hotel’s entrance.
Presiding Commissioner Gerardo Nograles of NLRC’s Fourth Division issued a 20-day temporary restraining order (TRO) against the workers, pending resolution of the labor dispute that flared up last month.
The hotel management filed with NLRC a complaint accusing the union members, affiliated with the Associated Labor Unions-Trade Union Congress of the Philippines (ALU-TUCP), of illegal acts such as “blocking, shoving, pushing and even threatening with physical harm other hotel workers.”
The striking workers also allegedly blocked private vehicles and taxis with potential guests, forcing the cancellation of some hotel bookings.
Holiday Plaza is also seeking the dismissal of 11 union members who took part in the “illegal” strike and who threatened those who wanted to enter the hotel during the past week.
However, lawyer Alfredo Garcia of ALU-TUCP said they will appeal the NLRC order, which they deemed void.
“Di na mahimo. A peaceful picket cannot be enjoined. It’s guaranteed under the Constitution. What they could enjoin are only unlawful acts. If we did anything illegal, we would have been already arrested,” Garcia said.
The group has been holding the picket since June 1 after a silent protest since May 20.
“As far as ALU-TUCP is concerned, we will continue our peaceful picketing,” ALU said in a statement.
They also denied prohibiting the entry of hotel workers, suppliers and clients.
The labor dispute star-ted with the management’s refusal to sign the collective bargaining agreement after two years of negotiations.
