Court tells gov’t: Don’t act on cement safeguard duty
MANILA—The Supreme Court has restrained the government from taking actions on the petition of local cement manufacturers for the extension of safeguard measures against the importation of gray Portland cement.
In a resolution, the SC directed the Department of Trade and Industry (DTI) and the Tariff Commission to maintain the status quo until further orders from the high court.
“Prudential considerations warrant the deferral of action on the petition for extension of safeguard measures now pending with the DTI and the Tariff Commission, until such time that the instant case is resolved with finality by this Court,” the SC said in a resolution.
Last year, the SC's Second Division voided the provisional measure of P20.60 per 40 kilogram bag that the DTI had imposed on imported gray Portland cement starting Nov. 7, 2001 on the request of the association of local cement manufacturers.
The trade department appealed the ruling, and the case is now pending resolution by the high court. (Sunnex)
