Workers cry illegal dismissal By Aledel Gonzalez-Cuizon Sun.Star Staff Reporter
Employees of a chemical dealer in Mandaue City complained they have been illegally dismissed from work.
The main office of Unified Chemical Industries Inc. has issued a memorandum informing the Mandaue City-based workers that their services will be terminated effective Oct. 15, 2005.
The employees were able to read the memorandum only last Sept. 15 and were immediately told to pack up and leave.
Closure
They were told that the Mandaue branch is due for closure.
The employees complained that they were not given due process. They said they were not properly evaluated on their sales performances, a requirement stated in the memorandum.
The employees also argued that their office could not be in dire straits because as sales representatives, they know that the company has stayed financially afloat.
Sales representative Edwina Resabal and six other employees of the firm filed a complaint with the National Labor Relations Commission 7 for illegal dismissal, underpayment and non-payment of their 13th month and separation pays.
Resabal said they were not able to inform their respective clients that they’re no longer connected with the company.
Clients
The company has employed six sales representatives, with clients from Metro Cebu and outside the province.
Each sales representative has an average of 30 clients.
In an interview, Resabal claimed that branch manager Thelma Salvacion still continues to hold office at the Mandaue branch, even if her services have also been terminated.
Sun.Star Cebu visited the office of Unified Chemicals Industries yesterday morning, but Salvacion refused to comment. She said she was one of the workers who lost their jobs, so she could not say anything.
Resabal’s complaint named Salvacion, aside from company owner Elvira Hizon, as respondent.
Resabal said the company reported that its income as of last year was only P360,000. However, a production report covering March 1, 2004 to February 28, 2005 states that the company has a cumulative income of some P4.3 million.
