OCT issued for 210 hectares of SRP land
Cebu City finally has its hands on the original certificate of title for the South Reclamation Project (SRP). The title, which contains the exact provisions of the special patent issued by Environment Secretary Michael Defensor, covers an area of 210.074 hectares.
It was transcribed and registered by the Registry of Deeds last Sept. 22.
Only one title has been issued for seven parcels of land at the SRP: lot 1-A covers 31.9189 hectares (has.); lot 1-B, 61.6052 has.; lot 1-D, 58.4128 has.; lot 1-E, 5.2266 has.; lot 1-F, 15.7135 has.; lot 1-G, 35.9219 has.; and lot 1-L, 1.2751 has.
The special patent remains controversial because the Talisay City Government has announced it will pursue its claim over 53.44 hectares of the SRP.
The SRP covers 295 hectares and cost about P6.3 billion under current foreign exchange rates. The Japan Bank for International Cooperation provided the loan almost a decade ago.
The original certificate of title 0-3581 was registered at the Registry of Deeds of Cebu City based on special patent 3693.
It did not contain any memorandum of encumbrances.
The special patent and the certificate of title referred to Proclamation 843, which President Arroyo issued last May 16, 2005.
Proclamation 843 amended Proclamation 200-A, series of 1967, by “reserving a portion of the area as the Cebu South Reclamation Project and transferring its ownership to the City Government of Cebu and declaring such area as alienable and disposable.”
Proclamation 200-A, dated May 22, 1967, reserved “certain parcels of land of public domain located in San Nicolas, Pardo (now part of Cebu City) and Tangke, Talisay (now Talisay City) for national improvement purposes.”
The special patent and the title, however, also state that the SRP is “subject to recall when public interest and welfare so demand.”
Proclamation 843 also authorized the environment secretary to issue a special patent “in favor of the City Government of Cebu over the parcels of land covered by the said Proclamation 843.”
The technical descriptions (boundaries) of all parcels of land covered by the original certificate of title are based on an original survey on Nov. 24, 2001 and on a special plan (survey) executed by geodetic engineer Edgar T. Batiquin on June 2, 2005.
