Cebu City IBP seeks transfer of judge

After receiving numerous complaints from lawyers, litigants and witnesses, the Integrated Bar of the Philippines (IBP) Cebu City Chapter is asking the Supreme Court (SC) to transfer a Regional Trial Court judge outside Cebu Province.

In a resolution that was unanimously passed, the IBP Cebu City Chapter also asked the High Court to look into the complaints.

“Despite having been already reprimanded by the SC for dishonesty, (he) has not corrected his discourteous, abusive, cruel and tyrannical behavior,” the resolution read.

Lawyer Gloria Lastimosa-Dalawampu said the board resolution was carried last Oct. 6 but it was signed only yesterday.

Among the complaints raised against the judge:

* He berates in open court a lawyer who is in his late 70s;

* He scolds for no sufficient reason lawyers, litigants and witnesses in court, which causes embarrassment and humiliation;

* He indiscriminately imposes fine and threatens lawyers and other court clients with contempt of court, without any reason;

* He adopts his own style and procedure in court;

* He displays arrogance and haughtiness, lack of respect to the court itself during court proceedings by exercising on the rostrum; facing the wall and turning the back of his swivel chair to the public during hearings; and

* He is cruel as shown by an incident where he forced a litigant to swallow instead of spit a bubble gum.

The Cebu City lawyers said the judge’s transfer is needed so that the litigants and lawyers can air their grievances without fear that their case before the judge would be prejudiced.

“(This is also) to avoid the possibility that court personnel may be unduly pressured into falsely testifying in favor of the judge,” their resolution read.

The IBP Cebu City chapter furnished copies of the resolution to Chief Justice Hilario Davide Jr., the Judicial and Bar Council, IBP National Office and RTC Executive Judge Simeon Dumdum. (GN)
