Prolonged rest or extra pay?

The long holiday beginning today will give workers a chance to either rest or earn up to 160 percent in extra pay.

Today and tomorrow were declared by Malacañang as special non-working days. It will also be a regular holiday on Nov. 4.
Nov. 2 and 3, however, are regular working days.

Anticipating confusion as to how the extra pay should be computed, the Department of Labor and Employment (Dole) has issued some guidelines.

The guidelines are based on Dole Memorandum Circular No. 1.

Those who will work on the special non-working days (Oct. 31 and Nov. 1) will get 30 percent on top of their daily rate for the first eight hours of work. An additional 30 percent of the hourly rate will be given if the employee works beyond the eight hours.

An employee, however, will be getting 50 percent additional pay if he reports for work today or tomorrow even if it is his regular rest day. An additional 30 percent of the hourly rate will also be given if he works beyond the eight hours.

But if the worker does not work on the special non-working days, the no work, no pay policy shall apply, unless there is a favorable company policy, practice or collective bargaining agreement.

Regular holiday

For the Nov. 4 holiday, Labor Undersecretary for Workers’ Welfare Luzviminda Padilla said the computation will still be based on the circular.

If the day is an employee’s regular workday but the employee does not work, the employee will still get 100 percent of his regular salary for that day.

The same rule will apply if the day happens to be a worker’s day off and he chooses to rest on that day.

If he works that day, the worker will get an additional 100 percent on top of his daily rate for the first eight hours of work rendered. In excess of eight hours, the worker gets an additional 30 percent of his hourly rate.

If Nov. 4 falls on a worker’s day off and he is asked to work, he will get an additional 130 percent on top of his daily rate for the first eight hours, and will get 30 percent more of his hourly rate if he exceeds eight hours. (PNA)
