Fiscals seek time to fix mix-up
Ruben Ecleo Jr. has until Jan. 20 to comment on the prosecution’s intention to file an amended formal offer of exhibits for the parricide case against him.
But defense lawyer Orlando Salatandre already manifested that he will only accept the evidence submitted on time.
The deadline for the prosecution to offer evidence was Jan. 5, but the panel sought an extension of 10 days. The court, though, gave them until Jan. 10, which they were barely able to beat.
However, after going over the documents, the court found that there were three sets of exhibits in court.
The prosecution blamed the confusion on its messenger who filed two additional exhibits.
In an urgent motion filed last Tuesday, the prosecution asked the court that they be allowed to withdraw their formal offer of exhibits and the two additional exhibits filed.
“We respectfully file this urgent motion seeking the permission of the court to withdraw the Formal Offer of Exhibits filed on Jan. 10, 2006 and two subsequent Formal Offer of Exhibits erroneously filed by the messenger of the private prosecution,” the motion read.
Private Prosecutor and spokesperson lawyer Fritz Quiñanola told Sun.Star Cebu that they are going to file an amended offer of exhibits after one week.
The three exhibits were marred with inconsistencies.
Quiñanola explained that there were evidence that were not found in the files of the court and they had to trace where they were. He said that it was only due to miscommunication.
But he assured though there will be no more postponements from their part after they submit the amended offer.
“We only want to rectify the inconsistencies of the formal offer of exhibits earlier filed, said inconsistencies were due to time constraints and other factors beyond the control of the prosecution,” stated the motion.
Regional Trial Court Judge Geraldine Faith Econg scheduled a hearing on the 20th.
Ecleo is the main suspect for the death of his wife Alona Bacolod. Members of the Integrated Bar of the Philippines are leading the prosecution, in honor of their fallen colleague, Arbet Sta. Ana-Yongco who actively prosecuted the case until her death in 2004. (JGA)
