Official risks 90-day penalty

A BARANGAY councilor of Mahanlud, Malabuyoc, southwestern Cebu is suspended for three months after being found guilty of taking part in a brawl that injured a man.

Macephil Macion Jr., in a hearing on the allegations, did not deny his participation in a “drinking spree,” according to a Municipal Council resolution.

The municipal council is, under the law, empowered to investigate accusations against barangay officials.

The council passed a resolution authorizing Mayor Daisy Creus to impose a three month-suspension on Macion.

A certain Angelito Fuentes filed the administrative complaint against Macion for conduct unbecoming of a public official.

Evidence

Fuentes alleged that last May 21, 2004, Macion was drinking with several friends and when they got drunk, Macion and two others “physically abused” him.

Fuentes presented before the council a medical certificate signed by Dr. Runiquisa Saavedra, the municipal physician.

It certified that Fuentes suffered from bruises and contusions from “blunt force.”

“In the investigation conducted by this (council), Macion failed to give evidence or present credible witnesses that may refute the allegations made by the complainant,” the resolution read.

“Furthermore, at no time in the hearing did Macion deny participating in this alleged drinking spree and being drunk in public,” the council added.

The document, received by the Provincial Board and to be acted upon in today’s regular session, further stated that majority of the town councilors voted that Macion was guilty.

“With a strong evidence of guilt, this body authorizes the municipal mayor to suspend Macion for three months as disciplinary action for an offense involving moral turpitude,” the council ruled.

The Local Government Code provides that complaints against elective barangay officials shall be filed before the municipal council concerned, whose decision shall be “final and executory.” (JPM)
