City rejects golf club’s offer of P700T taxes

THERE will be no more settlement between the Cebu City Government and the Alta Vista Golf and Country Club.

Cebu City Mayor Tomas Osmeña, through his lawyers, said he was not satisfied with the offer of the country club, which filed a civil suit against him and City Treasurer Teresita Camarillo for issuing a closure order against the golf course.

The closure order was a result of Alta Vista’s non-payment of amusement taxes.

Alta Vista earlier manifested in court its willingness to pay amusement taxes under protest, or until the issue is resolved by the court.

But according to lawyer Jerone Castillo, who is representing the City Government along with three other City Hall lawyers, Alta Vista only offered to pay P700,000.

The amount, which constitutes half of the City’s tax collectibles from the country club in 1997-1998, was not acceptable to Osmeña, said Castillo.

With the failure of both parties to reach a settlement, the application for temporary restraining order (TRO) continues.

Regional Trial Court Judge Geraldine Faith Econg ordered both parties to file a position paper in relation to the TRO.

While the country club filed an injunction case against the City Government, its priority in the meantime is the issuance of a TRO for the opening of the golf course.

Citing Alta Vista’s non-payment of amusement taxes, the City refused to issue a business permit to the country club and issued a closure order last December.

But Alta Vista argued that they should not be paying amusement taxes since the Local Government Code defines amusement places as “theaters, cinemas, concert halls (and) circuses where one seeks admission to entertain oneself by seeing or viewing the show or performances.” (JGA)
