Pinamungajan mayor ordered to explain failure

The Office of the Ombudsman warned a Cebu town mayor that failure to suspend a barangay captain is a ground for disciplinary action.

Ombudsman Director Virginia Palanca-Santiago ordered Pinamungajan Mayor Jeffrey Yapha, through a letter, to implement a suspension order on Tajao Barangay Captain Luzviminda Amarilla.

“You are warned that your failure to comply with our order is ground for disciplinary action,” read Santiago’s letter to Yapha.

Ombudsman Director Edgardo Canton, in a November 2005 order, also called Yapha’s attention for the same infraction.

Sun.Star Cebu tried to reach the mayor yesterday but was told that he was attending to his sister who was taken to the hospital.

Santiago said the anti-graft office was informed that Amarilla continues to perform her duties as barangay captain as of last Jan. 8.

This is the second time they received such information.

The ombudsman order, however, did not state Amarilla’s infraction.

Attached to Santiago’s letter was a shipper’s information from the mail courier to prove that the letter was received by Yapha, through a certain Arlene, last November yet.

No reply was sent from Yapha’s office since then.

Santiago quoted a section of the Code of Conduct and Ethical Standards for Public Officials and Employees as basis for the warning against Yapha.

“Act promptly on letters and request. All public officials and employees shall within 15 working days from receipt thereof, respond to letter, telegrams or other means of communications sent by the public,” the code read.

“The reply must contain the action taken on the request,” it added.

In this case, more than four months have lapsed, and there is no answer yet from Yapha.

“You are therefore ordered to explain in writing why no disciplinary action should be taken against you for your failure to implement our suspension order and for your failure to reply to our letter,” wrote Santiago.

Yapha was given five days from receipt of the order to submit his formal explanation. (JGA)
