CH told to defend bid to cancel surveys
The Provincial Environment and Natural Resources Office (Penro) ordered Cebu City Hall and the Department of Public Works and Highways (DPWH) to state why the approved surveys of an 11-hectare portion of the SRP under the name of a private person in Barangay Tangke, Talisay City should be cancelled.
The Penro is hearing the City’s request to cancel two approved surveys of a property within the South Reclamation Project (SRP) under the name of Sofia L. Canton.
The City wants the lots titled under its name.
Cebu City had anticipated that the Department of Environment and Natural Resources (DENR) would release last month the special patents for the eight remaining parcels of land in the SRP.
It applied for special patent covering 15 parcels of land at the 295-hectare SRP. But the DENR did not allow the inclusion of those occupied by the South Coastal Road, those with approved land surveys and the unfilled Pond A.
Last September, only one special patent was issued for 210 of the 295 hectares of the SRP. Special Patent 3693 covers only seven instead of the original 15 parcels that the City sought.
Procedures
But the City already acquired separate titles for each seven parcels.
“While I am lamenting the delay of the issuance of the special patents, I have to respect the procedures for the proper solution of the case,” said SRP manager Nigel Paul Villarete yesterday.
Despite the delay, Villarete is optimistic the remaining titles will be issued because the approved land surveys are merely completed surveys of the reserved area covered by the Presidential Proclamation 200-A and no title has been issued on the property.
He said Presidential Proclamation 843 has amended, however, the previous proclamation and declared the transfer of its ownership to Cebu City.
The City, the DPWH and the heirs of Canton, represented by Macaraig L. Canton Jr., were given 10 days to submit their position papers to Penro.
Since the City Environment and Natural Resources Office lacks a hearing officer for the evaluation, Miguel Avanzado, lands management officer III of Penro, is handling the case.
Avanzado also ordered both the City Government and DPWH to include in their position paper whether they will compensate the Cantons of the parcels of land involved.
The Cantons were also ordered to comment on why the surveys should not be cancelled, and, if they agree to the cancellation, why there should be a compensation for it.
Unless the approved surveys are cancelled, the 11 hectares will not be titled under the City’s name.
Villarete said yesterday that the 60-hectare unfilled Pond A can’t be titled because it is still under water.
“But I don’t think there should be haste to fill up Pond A because there is still too much land (around it),” he told Sun.Star Cebu.

He also said that Pond A is already covered by Proclamation 843, which is among the existing documents that say the SRP is owned by Cebu City.
Apart from Pond A, the South Coastal Road, which is composed of three parcels of land or approximately 21 hectares, will not be titled under the City’s name as it will remain owned by the National Government.
“It is up to DPWH to apply for a title but most of the national roads in the country are not even titled. But DPWH has the option to apply,” the SRP manager said. (GAC)
