Exporters ask GMA, DOF not to enforce RA 9280 yet

Philippines exporters have signed a manifesto asking President Arroyo, the Department of Finance and Congress to hold back the implementation of the Customs Brokers Act of 2004.

Republic Act (RA) 9280, also known as the Customs Brokers Act of 2004, will allow only customs brokers and their customs representatives to transact business with the Bureau of Customs. It prevents exporters from processing, on their own or their designated personnel, documents related to export or import cargoes.

Red tape

In a statement furnished to Sun.Star Cebu, exporters said the implementation of the RA 9280 will “mean additional red tape and expense to exporters and make Philippine products uncompetitive in world trade.”

Exporters said having customs brokers process their shipment documents is not necessary because they electronically log on their exports.

The manifesto was signed by representatives of various export sectors like furniture, fashion accessories, metals, houseware, marble and leather goods, among others.

In a dialogue between Cebu exporters and customs brokers earlier, Porferio Montesclaros of the Mactan Export Processing Zone Chamber of Exporters and Manufacturers said the implementation of RA 9280 will cause delays in business operations and will increase cost of doing business.

He pointed out that the services of customs brokers, as provided in Section 6 of RA 9280, were the same things that exporters did when processing shipments.

These services include, among others, consultation on tariff and customs laws, preparation of required documents for import and export, declaration of customs duties and taxes and preparation, signing, recording and processing of (import and export) entries. (ALC)
